So if sheriff joe doesn't want to give up his right to appeal he only has to refuse to admit guilt & accept the pardon offered. He wants both.....

The U.S. Justice Department has Sheriff Joe’s back.
The department on Monday demanded an Arizona federal court toss out its entire case against law-breaking lawman Joe Arpaio because President Trump pardoned him.
Arpaio’s lawyer had already asked for the court to erase his conviction — a rare move following a presidential pardon. In court papers filed Monday, the Justice Department takes Arpaio’s side against the federal court system.

In court docs, the department argues that Trump’s pardon made Arpaio’s conviction “moot” and the court should “vacate all orders” against the disgraced former sheriff.


“A pardon issued before entry of final judgment moots a criminal case because the defendant will face no consequences that result from the guilty verdict,” the department said.
Trump in August issued a pardon for Arpaio, who would be sentenced to up to six months in jail for criminal contempt. His conviction came from violating a court order to stop his office’s discriminatory and violent policing in Maricopa County.
But Arpaio thought that wasn’t enough. His lawyers filed a motion asking the Arizona court to vacate the verdict altogether, since Arpaio would not get a chance to appeal the verdict before the U.S. Supreme Court as he had intended.
A pardon does not wipe away a conviction, and the Justice Department does not have authority to do so. Only the court of conviction can choose to reverse a conviction.
The court had no immediate response.
